Terms of use of ‘Make the Leap’
applicable to Visitors and Service Providers

Please read these tems carefully - you may use the Site if (and only if) you accept them in their entirety.

1 The Site:

  • The Make the Leap website is owned and managed by Make the Leap Limited, a company incorporated in England under company no 04325792, of Pegaxis House Suite 9, 61 Victoria Road, Surbiton, Surrey KT6 4JX, United Kingdom.
  • Make the Leap Limited seeks to assist companies wishing to expand in international markets, by providing guidance to assist in decision taking and risk evaluation, and by doing so in a location where Service Providers offering relevant services can advertise those services.

2. Definitions:

  • ‘Site’ means the Make the Leap website
  • ‘Service Provider’ means a person or body making use of Make the Leap in order to advertise relevant services
  • ‘Visitor’ means a person or body making use of Make the Leap for any purpose other than as an Service Provider
  • ‘Unlawful’ means such as might give rise to any actual or potential liability, civil or criminal, either under the laws of England and Wales, or under the laws of any other jurisdiction to which Make the Leap may be subject
  • ‘Users’ includes both Visitors and Service Providers
  • ‘Advertisement’ includes links to sites of Service Providers and others.

3. Use of the Site:

  • is permitted only subject to the edition of these terms and conditions currently in force
  • is free of charge to Visitors
  • is charged to Service Providers, subject to any initial evaluation period that may be offered
  • is confidential; names and addresses of Visitors will not be disclosed by Make the Leap, other than as may be required by law.

4. Users must

  • fully indemnify Make the Leap against any liability (including the legal costs of a successful defence or of a compromise) on the indemnity basis as a result of any claim being made against Make the Leap, in relation to any use of the Site by the User
  • not use the Site for any unlawful purpose or in any unlawful manner.

5. Service Providers must:

  • disclose their true name and address when submitting advertisements
  • be legally entitled to offer the goods or services they advertise
  • accept sole responsibility for the contents of their advertisements
  • take all reasonable steps to ensure that the information any advertisement contains is in all respects truthful, accurate, and lawful, and that any advertisement is and remains in no way deceptive, inaccurate or misleading
  • ensure that all advertisements they submit are in no way unlawful, and comply in all respects with the British Code of Advertising Practice, with the Financial Services Act 1986, and with all other relevant legal requirements.

6. Visitors must accept sole responsibility for satisfying themselves

  • as to the suitability, qualifications and experience of any Service Provider with whom they may make contact or deal following introduction by an advertisement on the Site
  • of the accuracy completeness and suitability of any information on the Site or in any Advertisement by independent enquiry and investigation before taking any decisions in reliance on such information.

7. Make the Leap

  • does not vet or otherwise take up references in respect of Service Providers
  • reserves the right in its absolute discretion to refuse or remove any advertisement (without being required to give reasons), and to edit or classify any advertisement as it sees fit
  • reserves the right in its absolute discretion to withdraw the use of the Site from any User without notice and without being required to provide reasons
  • retains copyright and database right in the advertisement database and all material on the Site
  • makes no warranties with respect to the Site or any information therein
  • has no other financial interest in the subject matter of any advertisement, or in the outcome of any arrangements which may be made as a result of a Visitor contacting a Service Provider, save for fees charged to Service Providers for hosting advertisements
  • does not provide any form of investment advice, and does not advertise or sell investment opportunities on its own behalf.

8. Liability:

  • MAKE THE LEAP is intended to provide no more than general guidelines for consideration, and is not intended to constitute an exhaustive process for the management of international expansion. It is necessary for any Visitor to take his or her own decisions based on his or her own judgment, after seeking such professional advice as is appropriate, and taking into account all such factors as may be relevant to his or her situation.
  • ALL MATERIAL PUBLISHED BY MAKE THE LEAP IS PUBLISHED IN GOOD FAITH, BUT NO LIABILITY IS ACCEPTED FOR ANY ERRORS, OR FOR ANY LOSSES THAT MAY BE INCURRED IF ANY INFORMATION ON THE SITE IS RELIED ON.
  • IN NO CIRCUMSTANCES IS ANY RESPONSIBILITY ACCEPTED FOR THE ACCURACY OF ANY ADVERTISEMENT (NOR IS ANY WARRANTY EXPRESSED OR IMPLIED BY SUCH PUBLICATION) OR FOR THE SUITABILITY OF ANY SERVICE PROVIDER FOR ANY PURPOSES; AND MAKE THE LEAP SPECIFICALLY DISCLAIMS ALL AND ANY LIABILITY TO USERS OF ANY KIND FOR LOSS OR DAMAGE OF ANY KIND AND HOWSOEVER ARISING, WHETHER DUE TO INACCURACY, ERROR, OMISSION, OR ANY OTHER CAUSE, AND WHETHER ON THE PART OF MAKE THE LEAP OR ON THE PART OF ANY OTHER
  • TO THE EXTENT PERMITTED BY THE APPLICABLE LAW, MAKE THE LEAP DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SITE AND ANY INFORMATION THEREON, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.
  • THE SITE IS PROVIDED ‘AS IS’, AND USERS ACKNOWLEDGE THAT IT IS NOT TECHNICALLY PRACTICABLE TO GUARANTEE SUCH A SERVICE :TO BE ERROR-FREE. USERS AGREE THAT IF ANY ERRORS ARE FOUND TO EXIST THEY SHALL NOT CONSTITUTE A BREACH OF THESE TERMS, AND SHALL NOT GIVE RISE TO ANY LIABILITY.
  • IN NO EVENT WILL MAKE THE LEAP BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE WHICH MAY ARISE IN RESPECT OF THE SITE, ITS USE, OR IN RESPECT OF OTHER EQUIPMENT OR PROPERTY, OR FOR LOSS OF PROFIT, BUSINESS, REVENUE, GOODWILL OR ANTICIPATED SAVINGS, EVEN IF MAKE THE LEAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS.
  • IN THE EVENT THAT ANY EXCLUSION CONTAINED IN THESE TERMS SHALL BE HELD TO BE INVALID FOR ANY REASON AND MAKE THE LEAP BECOMES LIABLE FOR LOSS OR DAMAGE THAT MAY LAWFULLY BE LIMITED, SUCH LIABILITY SHALL BE LIMITED TO £100 OR (IN THE CASE OF A THE CLAIM BY A SERVICE PROVIDER) THE SUM PAID BY IT FOR THE ADVERTISEMENT (IF HIGHER).
  • Make the Leap does not exclude liability for death or personal injury to the extent only that it arises as a result of its negligence (or that of others for whose acts and defaults they may be legally liable).

9. Miscellaneous:

  • by using the Site Users accept that these Terms supersede all prior agreements, and are complete and exclusive. No oral or written information given by or on behalf of Make the Leap shall create a warranty or collateral contract, or in any way increase the scope of Make the Leap’s liability in any way, and Users may not rely on any such information.
  • the right is reserved to change these Terms from time to time without prior notice; any such revised Terms may be viewed at log-in.
  • if any provision in these Terms shall be determined to be invalid, such provision shall be deemed omitted; the remainder of these Terms shall stand.
  • these Terms shall be governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction in all matters arising.

WEB SITE PRIVACY STATEMENT FOR MAKE THE LEAP LIMITED

Make the Leap ("MTL", "we" etc) use the information we collect about you to provide you with access to our web site www.maketheleap.com. (the "Site") and in connection with any agreement (or prospective agreement) that you may have with us (or to perform any obligations thereunder). We only collect, hold and use this personal information as described here and we also set out what controls you have in respect of the information we hold about you.

What data do we collect?

Upon registration or at other times we may ask you to submit information such as your name, e-mail address, postal address and telephone number. Although you are under no obligation to provide such information, we may not be able to provide you with access to the Site if you decide not to.

With whom is the information shared?

MTL will not disclose your personal information to any third parties outside of MTL, provided always that MTL may disclose personal information:

  • To independent contractors or professional advisers if necessary in order for them to perform services for or on behalf of MTL;
  • If required to do so by law; or
  • If MTL believes that such action is necessary to protect and defend the rights, property or personal safety of MTL, the Site or its visitors.

MTL may disclose aggregate statistics about our site visitors, customers and sales in order to describe our services to prospective partners, advertisers and other reputable third parties and for other lawful purposes, but these statistics will include no personally identifying information.

Security

We have security measures in place to attempt to protect against the loss, misuse and alteration of customer data under our control. While we cannot ensure or guarantee that loss, misuse or alteration of data will not occur, we use our best efforts to prevent this.

Where is the information stored?

Personal information collected by Make the Leap Ltd. is currently stored within the United Kingdom.

In order to provide you with access to the services offered through our Site, the information you provide to us may be transferred to countries outside of the European Economic Area ("EEA"). By way of example, this may happen if any of our servers are from time to time located in a country outside of the EEA or one of our service providers is located in a country outside of the EEA. These countries may not have similar data protection laws to the EEA. In addition, if you use our services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those services.

By using this Site, you consent to the collection and use of your personal information by MTL as described here. If we change our privacy policy in any way, we will post these changes on this page.

Your rights

You have a legal right to a copy of all the personal information about you held by us. You also have a right to correct any errors in that information. You have a right to prevent us using your personal information for direct marketing purposes.

Use of Cookies
